These Terms of Service govern your use of Amaaya’s website and purchases made through our online store. In these terms, “Amaaya”, “we”, “us” and “our” refer to Amaaya.

Please read these terms together with our Shipping Policy, Return and Refund Policy and any applicable privacy notices. By using our website or placing an order, you agree to these terms to the extent permitted by applicable law.

1. Eligibility and lawful use

You must be at least 18 years old and legally capable of entering into a contract to place an order. Minors may browse with the supervision of a parent or legal guardian. You must not use our website or products for unlawful purposes, impersonate another person, submit fraudulent information or interfere with the website’s security or operation.

2. Products and information

We aim to provide clear, accurate product descriptions, prices and images. Colours and packaging may appear differently on different screens, and fragrance experiences vary between individuals. Product availability may change. We will not use these differences to exclude remedies for products that are defective or materially misdescribed.

Read the directions, ingredient information and warnings for each product before use. Our fragrance, aromatic and skincare products are not medicines and are not intended to diagnose, treat, cure or prevent disease. Traditional ingredient associations and sensory descriptions are not guarantees of therapeutic results. Patch-test topical products and discontinue use if irritation occurs. Seek qualified medical advice where appropriate.

3. Orders and acceptance

Placing an order constitutes an offer to purchase. An automated acknowledgement confirms receipt of your order, not necessarily its acceptance. Acceptance occurs when we confirm dispatch, unless we expressly confirm acceptance earlier.

We may decline or cancel an order for a legitimate reason, including unavailable stock, suspected fraud, an unserviceable delivery address or a material pricing error. If this occurs, we will notify you using the details provided and refund any payment collected for the cancelled items. We will not substitute a product or impose a revised price without your agreement.

4. Prices and payments

Prices are shown in Indian rupees unless stated otherwise. Applicable taxes and the total payable are shown at checkout. Prices and promotions may change for future purchases; such changes do not retrospectively alter an accepted order.

You must use a payment method you are authorised to use and provide accurate billing information. Available payment options are displayed at checkout. Payments may be processed by third-party providers subject to their applicable terms.

5. Account and contact information

Please provide accurate, complete delivery and contact information and keep any account credentials confidential. Notify us promptly of suspected unauthorised account use or an error in your order details. We may be unable to change an address after dispatch.

6. Shipping and delivery

Our Shipping Policy sets out processing and estimated delivery timelines. Standard domestic shipping within India is free, with no minimum order value or quantity. Delivery is subject to courier serviceability. Estimated timelines are not guarantees, but we will assist with delayed or missing deliveries. Nothing in these terms removes our responsibilities under applicable consumer law.

7. Returns, refunds and exchanges

Our Return and Refund Policy governs return requests, eligibility, exchanges and refunds. It provides a 14-day return-request window and free return shipping. Please contact us before sending an item back. Change-of-mind restrictions do not affect rights relating to defective, damaged, misdescribed or incorrectly supplied goods.

8. Website availability and corrections

Our store uses Shopify’s e-commerce platform. We may maintain, update or temporarily suspend website features where reasonably necessary. We cannot guarantee uninterrupted or error-free access. We may correct typographical errors or inaccurate listings; where an error affects an order, we will contact you and offer an appropriate resolution rather than unilaterally changing an agreed purchase.

9. Intellectual property

Website text, branding, photographs, designs and other original materials belong to Amaaya or their respective rights holders. You may view and share publicly available product information for lawful personal purposes. Reproduction for commercial exploitation or misleading use of our branding requires permission, except where otherwise permitted by law.

10. Reviews and submissions

Reviews and other submissions must be honest, relevant and lawful and must not infringe anyone’s rights. When you submit a review for publication, you grant us a non-exclusive permission to display it and make reasonable formatting edits without changing its meaning. We may remove unlawful, abusive, fraudulent or irrelevant content. We will seek separate permission where required for other uses of personal information or private correspondence.

11. Third-party services and links

Links and optional third-party tools may be provided for convenience. External websites and services have their own terms and privacy practices. Their inclusion does not necessarily imply endorsement. These provisions do not exclude any responsibility that applicable law places on Amaaya.

12. Privacy

Personal information is handled in accordance with our applicable privacy notices and legal obligations. Please consult the privacy information made available on our website. Do not submit sensitive payment credentials through ordinary email.

13. Prohibited conduct

You must not introduce malicious code, attempt unauthorised access, collect other users’ personal information without authority, engage in harassment or fraud, infringe intellectual property or misuse our services. We may restrict access where reasonably necessary to address such conduct, without removing your accrued consumer rights.

14. Liability and consumer protections

To the extent permitted by applicable law, we are not liable for indirect business losses arising from use of the website, such as lost profits resulting from an interruption. We do not exclude liability that cannot lawfully be excluded, including applicable obligations relating to defective products, fraud, negligence or consumer remedies. No statement in these terms overrides a statutory warranty or a non-excludable consumer right.

15. Responsibility for unlawful conduct

Where permitted by law, you may be responsible for reasonable, evidenced losses directly caused by your unlawful misuse of the website or infringement of a third party’s rights. This does not impose a blanket obligation on customers to reimburse Amaaya for matters outside their control.

16. Termination

You may stop using the website at any time. We may suspend access for material misuse or a serious breach of these terms. Termination does not extinguish obligations relating to accepted orders, refunds or rights accrued before termination.

17. Governing law and disputes

These terms are governed by the laws of India. Please first contact us so we can attempt to resolve any concern. Nothing prevents you from approaching an appropriate consumer commission, regulator or court with jurisdiction under applicable law.

18. Severability and entire agreement

If a provision is held unenforceable, the remaining provisions continue to apply to the extent permitted by law. These terms and the policies applicable to your purchase form the agreement relating to website use and that purchase, without excluding binding representations or rights recognised by law. A failure to enforce a provision does not waive the right to enforce it later.

19. Changes to these terms

We may update these terms by posting a revised version on this page. Changes apply prospectively and do not remove rights associated with orders already accepted. Where legally required, we will provide notice or obtain consent for material changes.
